1. Terms of Service

1.1 The service

VertClip is a web application that converts gaming footage into vertical clips and provides video editing tools. Features vary by plan and are described on the pricing page at the time of purchase.

1.2 Your account

• One account per person; one seat per subscription. Sharing accounts or credentials is prohibited.
• You are responsible for keeping your password and two-factor credentials secure.
• You must be at least 13 years old (or the minimum age in your country) to use VertClip.

1.3 Your content

You are responsible for having the rights to the footage you upload and to any content you publish to third-party platforms through VertClip.

1.4 Acceptable use

• No attempts to bypass plan limits, quotas, paywalls, or security controls.
• No uploading unlawful content, malware, or content that infringes others' rights.
• No reselling, scraping, or automated abuse of the service.

We may suspend or terminate accounts that violate these terms. Where practical we will warn first; serious abuse (fraud, security attacks, illegal content) results in immediate termination without refund.

1.5 Subscriptions & billing

• The Free plan does not require a payment method and does not renew or create a charge. It includes five local exports per month, official templates, and mandatory VertClip branding, subject to the current product limits shown on the pricing page.
• Plans bill monthly or yearly in USD through Stripe and renew automatically until cancelled.
• You can cancel anytime from Account → Manage subscription; access continues until the end of the current trial or paid period.
• The optional one-time Creator trial requires a payment method collected securely by Stripe. You pay $0 for the first 24 hours, then the subscription automatically renews at $10 per month unless you cancel before the trial ends. VertClip does not receive or store raw card details.
• To enforce Free-plan and one-time trial allowances, VertClip derives a one-way keyed fingerprint from the network address reported by Cloudflare. The source address is not stored. IPv6 addresses are grouped by their /64 network prefix to limit allowance abuse through address rotation.
• Quotas (including clips per day or month and output length) are plan features enforced by the service; unused quota does not roll over and has no cash value.

1.6 Disclaimers & liability

The service is provided "as is". To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential damages, or for actions taken by third-party platforms (e.g. TikTok, YouTube) against your accounts.

1.7 Changes

We may update these terms; material changes are announced in-app and the version number above changes. Continued use after a change is acceptance of the new terms.

1.8 VertCut and third-party software

VertCut is desktop software provided by VertClip. Its availability follows the access terms shown on the VertCut download page.

VertCut includes separately licensed third-party software, including FFmpeg under the GNU Lesser General Public License version 3 or later. The desktop app and download page identify the exact corresponding source and include the applicable notices. Nothing in these terms limits rights granted by a third-party license, including reverse engineering needed to debug modifications to an LGPL-covered component.

2. Refund Policy — All Sales Final

• Try before you buy: the Free plan and optional Creator trial let you evaluate the service before paying. Purchases made after (or without) the trial are informed purchases.
• Cancellation, not refund: cancelling stops the next renewal; it does not refund the current period. You keep access until the period ends.
• Renewals: renewal dates are visible in Account → Billing at all times. Forgetting to cancel before a renewal is not grounds for a refund.
• Chargebacks: filing a payment dispute for a valid, delivered subscription is treated as fraud. We respond to disputes with the full service record: your acceptance of these policies (timestamp, IP address), login history, and usage logs (clips rendered, features used). Accounts that file invalid disputes are permanently banned.
• Exceptions required by law: where consumer law grants a mandatory withdrawal or refund right, we honor it to the letter of that law.

3. Privacy & Security Policy

3.1 What we collect

• Account data: email, password hash (never the password itself), subscription state.
• Usage data: clips rendered, features used, quotas — needed to run plan limits.
• Abuse-prevention data: a one-way keyed network fingerprint used to enforce Free-plan and trial allowances. VertClip does not store the source network address for this purpose.
• Legal acceptance records: policy version, timestamp, IP address and browser signature at the moment of acceptance (kept as evidence of contract formation).
• Your footage: cached in your browser; temporary encrypted processing copies exist only to deliver a render and are deleted after browser recovery.

3.2 What we never do

• No selling or renting personal data. No advertising use of your footage.
• No perpetual content licenses — you own your uploads (see 1.3).

3.3 Security measures

• All traffic encrypted (TLS); passwords hashed with PBKDF2-SHA256; sessions are signed and invalidated on sign-out and password change.
• Optional two-factor authentication: authenticator-app codes and passkeys (Account → Security).
• Payments are processed entirely by Stripe — card numbers never touch our servers.
• Server-side enforcement of all plan limits, rate limiting, and abuse controls.

3.4 Data deletion & export

Remove locally cached media anytime from the app or by clearing this site's browser data. From Dashboard > Account, you can download a portable copy of your data or submit an authenticated account-deletion request. A deletion request immediately deactivates the account, revokes active sessions, and schedules personal-data deletion within 30 days. We retain only records required for tax, accounting, fraud-prevention, dispute, or legal-defense purposes (including invoices, subscription history, and policy-acceptance records).
